Sleep Nurse Pip — Terms and Conditions of Service
1. Introduction
These Terms and Conditions ("Terms") govern the relationship between Phillipa Tucker trading as Sleep Nurse Pip ("Consultant", "we", "us") and you, the client ("Client", "you"), when you use any of the services described below.
By completing a booking, you confirm that you have read, understood, and agreed to these Terms.
These Terms are written in English. The English version is the governing version.
2. Definitions
"Consultant" means Phillipa Tucker, trading as Sleep Nurse Pip, P.IVA 13848520964.
"Client" means the adult (parent or primary caregiver) who purchases or uses the Services on behalf of their child.
"Child" means the infant or toddler aged 0 to 4 years (inclusive) on whose behalf the Client engages the Services.
"Services" means the sleep consulting services described in Clause 4.
"Sleep Plan" means a personalised written document prepared by the Consultant containing sleep guidance and strategies tailored to the Child.
"Booking Confirmation" means the email sent by the Consultant confirming that a booking has been accepted.
3. About the Consultant
3.1 Qualifications
The Consultant is a Certified Baby & Toddler Sleep Consultant and a Paediatric Registered Nurse registered with the Australian Health Practitioner Regulation Agency (AHPRA). She holds a Bachelor of Nursing and a Postgraduate Certificate in Paediatric Nursing, with 10 years of clinical experience at Sydney Children's Hospital Network.
The Consultant holds professional indemnity and public liability insurance.
3.2 Nature of services
The Consultant provides all Services in her capacity as a sleep consultant, not as a treating nurse, clinician, or medical professional. The Services are educational and advisory. They do not constitute medical diagnosis, treatment, or nursing care. Please read the Health Disclaimer (Schedule A) carefully.
4. Services
The Consultant offers sleep consulting packages, which may include a video consultation, personalised Sleep Plan, and a period of ongoing support (by email and/or WhatsApp). The specific inclusions, duration, and pricing for each package are communicated directly to the Client before booking.
5. Booking and Confirmation
5.1 How to book
Bookings are made by contacting the Consultant at pip@sleepnursepip.com or via the website, www.sleepnursepip.com. A booking is not confirmed until the Client has received a Booking Confirmation by email.
5.2 Contract formation
A binding agreement is formed when:
(a) the Client completes the booking process via the methods described in Clause 5.1 and confirms acceptance of these Terms, the Privacy Policy, the Health Disclaimer, and the Cookie Policy — as set out in the notice displayed on the website near the booking contact details (see the Website Notice text at the end of this document); and
(b) the Consultant sends a Booking Confirmation.
5.3 Intake form
Clients may be asked to complete an intake form before the consultation. The Client agrees to provide accurate and complete information. The Consultant is not responsible for outcomes arising from inaccurate or incomplete information.
6. Fees and Payment
6.1 Fees
The fees for each Service are communicated directly to the Client upon enquiry and before booking. Pricing is not currently displayed on the website; Clients must contact the Consultant directly for pricing. Prices shown to Italian clients are in Euros (EUR) and include IVA at 22%. Prices shown to non-Italian clients are in the currency as determined by the Consultant and do not include Italian IVA.
6.2 Payment method
Payment is currently by bank transfer only. Bank details will be provided in the Booking Confirmation or invoice.
6.3 When payment is due
Full payment is due before the consultation takes place. The Consultant will not proceed with the consultation until payment has been received and cleared.
6.4 Late payment
If payment is not received by the due date, the Consultant reserves the right to cancel the booking and release the appointment slot.
7. Cancellation, Refunds, and Rescheduling
7.1 Cancellation before the consultation
If the Client cancels more than 7 days before the scheduled consultation: a full refund is given, less any bank transfer fees incurred.
If the Client cancels 7 days or less before the scheduled consultation: no refund is given.
7.2 After the Sleep Plan has been delivered
Once the Sleep Plan has been delivered to the Client, the fee is non-refundable. The delivery of the Sleep Plan constitutes substantial performance of the service.
7.3 Cancellation by the Consultant
If the Consultant cancels a confirmed booking (other than due to Client default), the Client is entitled to a full refund or, at the Client's option, rescheduling to a mutually agreed date.
7.4 Rescheduling
Rescheduling requests should be made by email as early as possible and are at the Consultant's discretion.
8. Consumer Rights and Withdrawal
8.1 Right of withdrawal (Italian consumers)
If you are a consumer resident in Italy who contracted with the Consultant remotely (online, email, or phone), Italian consumer law gives you the right to withdraw from the contract without giving any reason within 14 calendar days of the Booking Confirmation date.
8.2 Loss of the right of withdrawal
Sleep Nurse Pip's services are delivered in three steps: (1) the Client completes an intake form; (2) a one-hour video consultation takes place to discuss the intake form, goals, and plan; (3) the Consultant writes and sends the Sleep Plan, which is digital content delivered electronically as a PDF (not on a tangible medium).
Completing the intake form (step 1) is pre-contractual information gathering only and does not, by itself, cause any loss of the withdrawal right — it is not "commencement of the Service" in a legally meaningful sense.
By ticking the consent checkbox on the intake form before the video consultation, you:
(a) expressly request that the service begin before the 14-day withdrawal period has expired;
(b) acknowledge that once the video consultation (step 2) has commenced, the right of withdrawal is lost in respect of the consultation component, as it will then have been fully performed with your prior express consent;
(c) acknowledge that once the Sleep Plan (step 3) has been delivered to you as digital content, the right of withdrawal is lost in respect of that component, as performance of digital content will then have begun with your prior express consent and acknowledgment that the right will thereby be lost.
Once both the video consultation has taken place and the Sleep Plan has been delivered, the right of withdrawal is fully extinguished. This is consistent with Clause 7.2 above.
8.3 How to exercise the right of withdrawal
If you wish to withdraw before the right is extinguished under Clause 8.2, notify the Consultant in writing at pip@sleepnursepip.com before the 14-day period expires. If you exercise this right, the Consultant will refund all payments without undue delay and no later than 14 days from receiving your withdrawal notice.
8.4 General consumer protections
Where applicable law in your country of residence gives you consumer rights that cannot be excluded (such as rights to remedies if a service is not provided with due care and skill), those rights apply and nothing in these Terms limits them.
9. Limitation of Liability
9.1 No guaranteed outcomes
The Consultant provides educational and advisory services. She cannot guarantee any particular sleep outcome. Sleep results depend on many factors outside the Consultant's control, including the Child's health, development, temperament, and the consistency with which the Sleep Plan is implemented.
9.2 Liability cap
To the fullest extent permitted by law, the Consultant's total liability to the Client is limited to the total fees actually paid by the Client for the specific Service giving rise to the claim.
9.3 Exclusions
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
Plain-English explanation (added per Pip's request): This clause means that although Clause 9.2 caps the Consultant's liability generally, that cap cannot apply to the most serious types of harm — death or injury caused by negligence, or anything resulting from fraud. Clauses like this exist in nearly every professional services contract because most consumer protection laws (Italian, Australian, and others) do not allow a business to contract out of liability for these things, regardless of what the contract says. Its presence protects the Client and keeps the contract enforceable; its absence would not actually reduce Pip's exposure, since the underlying protections would still apply by law.
9.4 Force majeure
The Consultant is not liable for any delay or failure to deliver Services caused by circumstances outside her reasonable control (including illness, internet outages, or platform failures). The Consultant will use reasonable endeavours to reschedule.
10. Intellectual Property
All Sleep Plans, written materials, and other content produced by the Consultant are the intellectual property of Phillipa Tucker trading as Sleep Nurse Pip. Materials are provided for the Client's personal use only in relation to their own Child. The Client must not copy, share, or use materials for commercial purposes without prior written consent.
11. Health Disclaimer
The full Health Disclaimer is set out in Schedule A and is incorporated into these Terms. By accepting these Terms, the Client confirms that they have read and agreed to the Health Disclaimer.
In summary: Sleep Nurse Pip provides educational sleep consulting only — not medical advice, diagnosis, or treatment. If your Child has any medical condition or health concern, consult a qualified medical professional before implementing any sleep changes.
12. Confidentiality and Privacy
The Consultant will keep all Client and Child information strictly confidential. Please refer to the Privacy Policy for full details of how personal data is handled. The Privacy Policy is available at www.sleepnursepip.com and forms part of this agreement.
13. Governing Law
These Terms are governed by Italian law. Any dispute shall be subject to the jurisdiction of the courts of Milan (Foro di Milano), Italy, without prejudice to your mandatory consumer rights under the law of your country of residence.

14. General
14.1 Entire agreement
These Terms, together with the Privacy Policy and Health Disclaimer (Schedule A), constitute the entire agreement between the Consultant and the Client.
14.2 Amendments
The Consultant may update these Terms from time to time. Updated Terms will be published on the website. Material changes affecting existing bookings will be communicated by email.
14.3 Severability
If any provision of these Terms is found to be unenforceable, it shall be severed and the remaining Terms continue in full force.
14.4 Language
These Terms are in English. If an Italian translation is produced, the English version prevails in the event of conflict, unless applicable consumer law requires otherwise.

Schedule A — Health Disclaimer
This disclaimer forms Schedule A of the Terms and Conditions and is also published on the website and included in the intake form.
1. Nature of the Service
Sleep Nurse Pip provides educational and advisory infant and toddler sleep consulting services only.
The services — including video consultations, personalised Sleep Plans, and ongoing support — are designed to help parents understand and improve their child's sleep.
The services are not, and must not be treated as:
Medical advice, diagnosis, or treatment
Nursing care or clinical intervention
A substitute for the advice of a doctor, paediatrician, or other medical professional
2. The Consultant's Role
Phillipa Tucker is a Certified Baby & Toddler Sleep Consultant and a Paediatric Registered Nurse (AHPRA — Australia). When delivering Sleep Nurse Pip services, she acts exclusively as a sleep consultant, not as a treating nurse or clinician.
The Sleep Plans and strategies she provides are guidance tailored to your child's age, developmental stage, and the circumstances you have described. They are designed to be implemented by a parent using their own judgment, with appropriate medical input where relevant.
3. Your Child's Health
Before implementing any sleep plan or strategy, you must:
1. Ensure your child is under the care of a qualified doctor or paediatrician.
2. Inform your treating medical professional that you intend to make changes to your child's sleep routine.
3. Seek medical clearance if your child has — or you suspect they may have — any medical condition, including (but not limited to): reflux, breathing concerns, feeding difficulties, developmental delays, allergies, prematurity, or any other relevant condition.
Sleep Nurse Pip cannot assess, diagnose, or treat medical conditions. If a medical concern is identified during the service, the Consultant will recommend that you consult a medical professional.
4. Your Responsibilities
By engaging Sleep Nurse Pip's services, you:
(a) Confirm that your child is in good general health and under appropriate medical care;
(b) Confirm you are not using these services as a substitute for medical advice;
(c) Acknowledge that sleep strategies are recommendations — you are responsible for assessing their suitability and deciding how to implement them;
(d) Acknowledge that sleep results vary and no particular outcome is guaranteed;
(e) Agree to inform the Consultant of any new health concern arising during the service.
5. Limitation of Liability
Sleep Nurse Pip is not liable for any adverse outcome to your child arising from the implementation or non-implementation of sleep advice. Nothing in this disclaimer limits liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
6. Emergency Situations
This service is not an emergency service. If you believe your child is unwell, in distress, or in danger, contact emergency services immediately:

7. Acknowledgment
By booking a service or completing the intake form, you confirm that you have read and understood this Health Disclaimer and agree to its terms.

Information about your child's health, medical history, and developmental status is sensitive data that attracts a higher level of legal protection. We process it only on the basis of your explicit consent (see Section 3).
2.4 Website data
If you visit our website, standard technical data (IP address, browser type, pages visited) may be collected automatically. See our separate Cookie Policy for details.
3. Why We Collect Your Data
3.1 How we collect consent for health data
Before you share health information about your child, we will ask for your explicit consent via a clearly-worded checkbox on the intake form — separate from general T&Cs acceptance. You can withdraw this consent at any time (see Section 5). Withdrawal does not affect the lawfulness of processing before withdrawal.
4. How Long We Keep Your Data
We do not keep data longer than necessary.
5. Your Rights
You have the following rights over your personal data:

In the event of a data breach likely to affect your rights, we will notify the relevant authorities within 72 hours and, where required, notify you directly.
9. Privacy Standards for All Clients
We apply equivalent privacy standards for all clients regardless of their country of residence.
10. Children's Data
Our services involve data about children aged 0 to 4 years (inclusive), provided by parents or caregivers. We collect only what is necessary to deliver the sleep consulting service and apply a higher standard of care to this data, particularly health-related information. We do not collect data from children directly.
